Cape man charged with aggravated assault after threatening man with pellet gun
A Cape Coral man was arrested after police said he threatened a worker to move his truck with a pellet gun.
Sergio Hernandez, 59, has been charged with aggravated assault with a deadly weapon without intent to kill stemming from a May 15 incident.
According to Cape Coral Police Department officials, last Friday just after 5:45 p.m., officers responded to a disturbance at 1510 S.E. 42nd St. by a caller that was hired to do work in the area.
Police officials stated the caller told officers that Hernandez came outside of his home and began arguing with him, telling him to move his truck.
“The caller stated Hernandez then pointed what appeared to be a black pistol at him while standing within approximately 10 feet,” a released from CCPD stated. “The caller said he feared Hernandez was going to shoot him and wished to pursue charges.”
CCPD officials stated officers spoke with witnesses who corroborated the caller’s story, and said they heard yelling and saw Hernandez point a weapon “directly” at the caller.
“Officers then spoke with Hernandez and recovered the weapon involved, which was determined to be a black handgun-style pellet gun resembling a standard firearm,” CCPD’s release stated. “The pellet gun was not loaded.”
Police officials stated based on the victim’s belief that the firearm was real and that Hernandez appeared to have the ability and intent to be violent with the weapon, along with the witness statements provided, Hernandez was arrested and taken to the Lee County Jail.
As of Tuesday morning, Hernandez will still in custody, being held on a $7,500 bond.
