CCPD officer arrested; accused of battering spouse

UPDATE:

A Cape Coral Police Department officer is on administrative leave after he was arrested Friday after he allegedly battered his spouse.

Officer Timothy Allen was charged with misdemeanor battery (touch or strike) and was taken to the Lee County jail late Friday afternoon. He bonded out shortly after midnight on a $5,000 bond, according to jail records.

The arrest came after CCPD officers responded to a disturbance involving the officer, who was off-duty.

According to the booking log related to the arrest, Allen and his wife “were in a physical altercation, and the husband threw the wife on the ground” where she incurred “injuries to both knees, her left elbow and the inside of her lip” as he attempted to retrieve his cell phone.

She called 911 for assistance.

Allen told responding officers that “the altercation between them was a verbal argument and never became physical in any way,” according to the probable cause affidavit.

He declined to provide a written statement, documents state.

Responding officers took photos of the injuries the woman said she sustained.

CCPD officials stated in a release its investigation “determined that Allen battered his spouse.”

He was arrested on scene.

Officer Allen “was immediately placed on Administrative Leave pending the outcome of an internal investigation,” CCPD officials stated in a release shared with the public via social media.

“As chief, I want to be clear that no one is above the law — regardless of their position or profession,” Chief Anthony Sizemore stated in the release. “We hold our officers to the highest standards, and when those standards are not met, we will act swiftly and transparently. Accountability and public trust are foundational to our mission, and we are committed to ensuring both through fair and impartial enforcement of the law.”
