Cape man faces DUI-related charges in crash that killed one, injured four

The Cape Coral man accused of crashing into a Matlacha restaurant, killing an 80-year-old woman and injuring four other patrons, is now facing multiple DUI-related charges.

Cody J. Curtis, 24, was arrested Monday and charged with one count of DUI manslaughter, three counts of DUI with serious bodily injury, one count of DUI property damage, and one count of DUI injury, according to the Florida Highway Patrol.

Curtis’ blood alcohol concentration was .137%, according to the FHP release.

The level at which a driver in Florida is considered impaired is .08.

According to an earlier FHP release, Curtis was traveling east on Pine Island Road NW, south of Island Avenue on April 13 when his 1992 Nissan when off the roadway and entered the north gravel shoulder at about 5:50 p.m. The car then collided with a no-parking sign and wooden decorative post and traveled into the outside seating area of The BBQ Place at 4590 Pine Island Road.

The vehicle struck the building as well as a motorcycle parked at the restaurant, mailboxes and garbage cans, re-entered the roadway and struck the pickup truck, according to FHP.

“Florida Highway Patrol State Troopers continue to conduct an exhaustive investigation,” and the crash remains under active investigation, FHP officials said.

Curtis was transported to Lee County Jail. He remains there as of Monday afternoon. His bond has not yet been set.
