Mask mandate challenge a big loss in the court of public opinion

By Staff | Sep 9, 2021

To the editor:

Let’s see if I got this straight: Gov. Ron DeSantis issued an executive order banning school boards from enacting mask mandates in their districts. He further warned that if they did, he would withhold the salaries of any board member or superintendent who defied his order.

The order was challenged in court and a judge threw it out, saying DeSantis didn’t have the authority to issue such an edict.

In what sure looks like overt defiance of that decision, DeSantis’s education commissioner has already taken steps to withhold the salaries of school board members in two Florida counties anyhow.

If the state, under DeSantis’s direction, continues to enforce an order that was ruled illegal, would someone with a law degree please explain to me why DeSantis isn’t guilty of contempt of court, punishable by fines and/or imprisonment?
