Stilwell: It need not be this way

The Lee County manager situation is a problem. In addition to the facts, chairman Judah allowed his personal views to affect his professional judgment and failed to effectively perform the role of chairman. Had the Cabrera indictment not occurred, the matter would have disappeared.

The question of potential misconduct should have raised a “red flag.” Back in February, Mr. Judah had an obligation to immediately meet with Mr. Stillwell and gain full disclosure. He should have instructed legal counsel to do the same with Mr. Bigelow. And then, the two should have initiated a process to bring public closure.

That was six months ago. Instead, nothing happened!

The Cabrera indictment reopened the issue. As chairman, Mr. Judah should have met with Mr. Stilwell to “craft an agreement acceptable to all parties.” Such compromises occur daily in business. For example, “I agree to take an administrative leave with pay, with the understanding that if the deliberative process finds contrary to my position, I will resign and request the used leave days be converted to leave without pay.”

Again, nothing happened!

Finally, the matter was referred to legal counsel.

Mr. Judah had a primary duty to protect the county. It only required a simple statement. “Commissioners, this matter has been referred to legal counsel. I respectfully request you refrain from making any further public comment until legal counsel has submitted the findings. Any statement you make may jeopardize the legal standing of the county.”

Unfortunately, nothing happened!

As a result, the commissioners have made countless public statements. The media has had a “feeding frenzy.” The image of county government has taken another “hit.” Mr. Stillwell’s due process has been compromised. Still, the game goes on!
