Council to consider rezoning proposals

City staff and Cape Coral’s Planning & Zoning Commission have different recommendations on a zoning issue City Council will consider Wednesday.

The ordinance is a privately-initiated small-scale future land use map amendment from the Commercial/Professional (CP) classification to the Multi-Family Residential (MF) classification for one property on 1917 SW Santa Barbara Place.

The change would remove the potential for commercial development for the site and allow construction of up to nine units of multi-family development. The remainder of the block would retain the Commercial/ Professional future land use map classification.

Eight residential structures on seven properties are present in Block 3100, which is approximately half-built out area-wise. No commercial projects have occurred or been proposed for this block since 2005. Multi-family residential developments are adjacent to the property.

Staff says while other properties have multi-family structures that pre-date the designation of CP on this block, the rest of the block is undeveloped and has experienced assemblage.

Staff said approving the amendment would result in a “Spot” land use request, which would be an impediment to future assemblage, impact any commercial development adjacent to the property, and represent an intrusion of residential land use upon a commercial block.

Staff recommends denial while P&Z recommended approval by a 4-3 vote on Aug. 3.

Also on Council’s regular meeting agenda:

• In quasi-judicial hearing, Council will consider the vacation of plats for portions of the Barcelona and Malibu canals and an ordinance changing the zoning district map for land on Gleason Parkway from Professional (P) to Residential Multi-Family Low (RML) zone.

• The ratification of the Collective Bargaining Agreement between the city and the Fraternal Order of Police Lodge 33, representing both bargaining units, is on the consent agenda where it will automatically pass unless pulled for discussion by a member of the elected board.

• Also on the consent agenda is an amendment to the agreement for the construction of Sands and Joe Coviello parks with Wright Construction Group for exotic vegetation removal at a cost of $251,790. The amendment would raise the cost of the project to $5,696,809.

• The Youth Council will give its quarterly report to City Council to let it know what they have been up to, including setting its Spring Gala date to March 11.

• Council will fill a vacancy on the Budget Review Committee for an alternate and three positions and one alternate for the Parks and Recreation Advisory Board.

The meeting will begin at 4:30 p.m. City Hall is at 1015 Cultural Park Blvd.

Wednesday, at the regular City Council meeting at 4:30 p.m. at City Hall, one such ordinance has done just that, with city council having to decide on whom to side with.
