Death sought in case of fatal baby toss

TAMPA (AP) – Prosecutors will seek the death penalty for a man accused of his ex-girlfriend’s baby out a car on a Tampa highway, killing the infant.

Richard McTear Jr., 21, has pleaded not guilty to first-degree murder and other charges.

Assistant State Attorney Jalal Harb announced Wednesday at a court hearing that the state would pursue the death penalty.

Authorities say McTear threw 3-month-old Emanuel Wesley Murray down on the concrete during an argument with his 17-year-old ex-girlfriend May 5. Then he snatched up the infant and threw him out of the car on Interstate 275. The child’s body was found on the roadside by a passing motorist.
