Suspect won’t testify in his own defense
Murder suspect Dave Gaphoor is not going to testify in his own defense today in his trial in a Lee County Court.
Gaphoor is on trial for the November 2005 death of 25-year-old Jose Gomez at the victim’s Nalle Road residence in North Fort Myers. He is charged with first degree murder, two counts of attempted second-degree murder, one count of aggravated battery and one count of attempted home invasion robbery.
Closing arguments in the case are expected to start this afternoon.
The jury is currently at lunch and when it returns, Judge Mark Steinbeck said he will instruct the group not to infer anything in Gaphoor’s decision not to testify when assessing the facts of the case.
